For many years, workers at the Pantasote Plant in Passaic, New Jersey were exposed to dangerous levels of vinyl chloride, a deadly carcinogen, while their employer and the vinyl chloride industry concealed its hazards. This conspiracy of silence was shattered when litigation revealed how these chemical companies deliberately and willfully hid the truth about the dangers of vinyl chloride.

Workers at the Pantasote Plant in Passaic brought a class action lawsuit seeking medical monitoring for protection of early diseases related to their vinyl chloride exposure. In addition, the family of a deceased worker also brought a wrongful death claim.

In a landmark decision, Judge Winard of Essex County ruled that the conspiring chemical companies could be held responsible for the injuries suffered by these workers even though their products did not directly contact the workers. The court held that, by conspiring together, these companies aided and abetted each other and all should be held responsible for the injuries caused by vinyl chloride.
